We the People Shall Govern Ourselves
In an effort to preserve the future of the Human Race and encourage its continued evolution, with current technology and knowledge gained of human behavior, it is now possible to create a Government which serves our purpose in life. Which, when condensed into its purest and simplest form, is, in only two words: happy People. Such is the directive of this Government.
This Constitution shall be engraved in stone and placed for all to see and touch outside the halls of Congress. All Federal Elected and appointed Officials shall take an oath of office to uphold this Constitution, and shall swear to it with their hands placed upon it. This Constitution is not just words on a piece of paper: it shall have physical representation as a strong unbreakable contract of the People to themselves.
Premise: That governance by representatives of our best and brightest, in an environment free of undue influence and devoid of reason for corruption, is vastly preferable to governance by criminals and idiots.
Federal Government Structure and Powers
Showing the relative hierarchy and derivations: The best and brightest of the People are eligible to become President, Vice President, or a member of Congress. The Constitutional Committee is comprised of members of Congress, and is at the top of the power structure just below the People to enforce the Constitution upon the Government. The Supreme court is placed above the Government as well, to ensure adherence to law.

It is a simple concept: make yearly random selections of our best and brightest to lead us, using the People’s vote to ensure accuracy. Simple perhaps, but the impact is profound enough to shake the entire world to its core. The very foundation of corruption and greed, the bedrock upon which dictatorial empires are built, is eradicated. Imagine a world where the People can trust that their leaders are smart enough to handle the task, and motivated not by self-gain, but by what is best for us all, to live happily in peace and harmony. Not only is it possible, it is here.
Constitutional Committee
The Constitutional Committee is the highest authority in the United States. All branches of this Government are subordinate to the Constitutional Committee and shall abide by its decisions.
Constitutional Committee authorities:
- To review laws past and present for compliance with this Constitution and void or modify said laws if found to be in conflict with this Constitution.
- To review actions of Government Officials for conflict with this Constitution and take any actions deemed necessary or appropriate to restore compliance.
- To determine which entities or individuals are making or have made profit from the act of war and confiscate said gains. Profit from death, destruction and misery is a direct violation of this Constitution. There shall be no profit in war.
- To ensure that the Congress does not exercise powers or privileges not specifically listed in this Constitution or granted to it by the States.
- To usurp any and all powers necessary, for only the period of time needed to correct a conflict with this Constitution, excepting the power to modify this Constitution.
- To determine and apply punishments for violations against this Constitution.
- To hear and settle cases involving arguments regarding issues of Constitutionality.
The Constitutional Committee shall consist of seven members, chosen yearly by random drawing from the senior year members of Congress.
The Constitutional Committee shall operate by simple majority vote of its members.
(I1)
President
Shall be the Representative of the Federal Government to the States and chief negotiator in all matters between the Federal Government and the States.
Shall bear primary responsibility for the stability and direction of the Economy of the United States.
Shall have no executive authority excepting over the office of the President, with all recommendations being passed through the Congress for vote of approval into law.
Shall be responsible for the internal security of the United States.
Shall be Commander in Chief of the State militias during National Emergencies.
Shall be elected into office by popular vote as the candidate for President with the highest number of votes.
Shall have a vote in Congress accounting for ten percent of the total, excepting in a vote of no-confidence against this office.
Shall appoint Judges to the Supreme Court as seats become available, subject to approval by the Congress.
Shall be elected for a term of four years, with a maximum lifetime limit of two terms.
May grant pardons to Citizens, with the exception of appointed or elected Government Officials and business leaders. Accountability of leadership must be demanded and enforced.

Vice President
Shall be the Representative of the Federal Government to Foreign Nations and Entities and perform as chief negotiator in all matters between the Federal Government and Foreign Nations and Entities.
Shall bear primary responsibility for relations and agreements with Foreign Nations and Entities, along with primary responsibility for the safety and security of the United States from same.
Shall have no executive authority excepting over the office of the Vice President, with all recommendations being passed through the Congress for vote of approval into law.
Shall appoint Ambassadors to Foreign Nations, subject to approval by the Congress.
Shall be Commander in Chief of all United States Military Forces.
Shall not order any offensive or preemptive military action without prior approval from the Congress.
Shall have a vote in Congress accounting for five percent of the total, excepting in a vote of no-confidence against this office.
Shall be elected into office by popular vote as the candidate for Vice President with the highest number of votes.
Shall be elected for a term of four years, with a maximum lifetime limit of two terms.
Shall assume the seat of President in the event that the President is unable to function.
The office of Vice President is in no way subordinate to the office of President. (I56)

Congress
The Congress shall consist of three hundred members. Each State shall be represented by at least one member, with the remainder allocated to the States in proportion to the population of each State. A census of Citizen population shall be performed every ten years to determine the population of each State for the purpose of reallocation of the Congress.
Congressional service shall be for a term of four years.
Congress shall be divided into four groups: freshman, sophomore, junior and senior year members. Each year, after their final year of service, the senior members of Congress shall vacate their seats, resulting in one quarter of Congress being replaced each year. When any seat in Congress becomes vacant, three candidates for that seat will be chosen, via random selection from the list of registered candidates for that State seat. The registered voters of that State shall then cast their ballots on which of those three candidates best represents them, and the winning candidate, by count of popular vote, shall then fill that vacant Congressional seat.
Political Parties or other groups or organizations which may hold influence over the vote of a Congressional member are forbidden within the Congress. Every Congressional member shall vote independently and of their own free will and conscience.
No business, group or organization may contact or be represented by any other seat in Congress than those seats which are within the State in which that entity was formed. (I4)
No Foreign Nation or Foreign Entity shall address the Congress. (I5)
The Congress may override the Federal Military decisions of the Vice President with a vote of at least two-thirds, not including the vote of the Vice President.
The Congress shall endeavor to maintain a stable value to US currency.
The Congress shall endeavor to maintain a population which is sustainable upon the land. Each generation shall leave the country no worse than when they arrived. (I6)
The Congress shall endeavor to maintain a stable economy with full employment of American Citizens. (I7)
For as long as the United States utilizes Capitalism as its economic model of choice, Congress shall keep a strong tight grip around its neck. (I8)
Congress shall embrace the KISS Principle. (I9)
The Congress shall have the privilege to call upon any Citizen for testimony. Said Citizen shall testify, and shall answer truthfully all questions asked, regardless of whether they are self incriminating or not.
Members leaving the Congress shall continue to receive their compensation and benefits for a period of two years after service. No other compensation shall be allowed or awarded after this time.
Powers of congress
· To lay and collect taxes and fees upon Businesses, Imports and Exports for the purpose of funding the activities and obligations of the Federal Government.
· To regulate Commerce and participation with Foreign Nation and Foreign Entities.
· To establish laws on the subject of Naturalization and Citizenship for the United States.
· To establish laws on the subject of Bankruptcies throughout the United States.
· To set the Standards of Weights and Measures.
· To further the pursuit of Knowledge and Science through education and research.
· To establish laws concerning the Environment and the preservation thereof.
· To establish a Medical Review Board to ensure quality of Medical care, and to establish limits upon malpractice awards. (I57)
· To create and destroy United States Currency and regulate the value thereof.
· To provide for the punishment of counterfeiting the Currency of the United States.
· To establish and maintain Post Offices.
· To regulate all Financial Institutions and other large pools of Currency and assets which may have significant effect upon the People.
· To provide for the Retirement and Medical care of the People. (I58)
· To build and maintain roads and bridges. No roads or bridges receiving Federal funds for construction or maintenance may carry a toll or a fee for its usage.
· To define and punish Piracies and Felonies committed on the high Seas, and offenses against the Laws of Nations.
· To declare War, and to raise and support a Federal Military for the purpose of maintaining secure borders and protecting the States from invasion. Barring extraordinary circumstances, a limitation of two percent of GDP shall be placed upon the Federal Military budget during times of peace.
· To authorize or deny the use of Nuclear, Chemical, Biological or other weapons which may be capable of significant damage against humanity.
· To make all rules and regulations for the Federal Military.
· To establish appropriate compensation for Federal Elected and appointed Officials and for all other employees of the Federal Government. But no Federal pension shall exceed ten years, or be collected in addition to any other compensation, or exceed by ten percent the average pension of the equivalent private position.
· To establish and maintain a Workfare Program. (I58)
· To establish and make rules and laws for the protection of the People from harmful Business practices.
· To grant patents and Copyrights. No patent shall extend beyond five years. No copyright shall extend beyond three years, with the exception of copyrights on music which shall not extend beyond one year. The objects of all patents and copyrights, upon the expiration of the patents or copyrights thereon, shall become public property free for any use, modification and distribution to all Citizens.
· To lay and collect taxes upon incomes. Income taxes shall be fair to the true creators of wealth, the workers, with higher incomes paying a higher percentage of their incomes in taxes.
· To execute Public Works projects which are too large for the States, or which require coordination between States, but with prior approval from the States.
· To make all rules for the lending of currency to Banks and other Entities which wish to borrow from the Federal Government.
· To issue to each Citizen three unique identification numbers. One to be used solely by the Federal and State Governments for identification, voting rights and other general Government matters. One to be used for the sole purpose of tracking medical matters, both Government and private. And one to be used for the sole purpose of all other commercial business. The three numbers shall be independent, and knowing any one or two shall not facilitate knowing the third. Neither shall any of the numbers contain any information about the holder.
· To cast a vote of no confidence against any elected or appointed Federal Official. A vote of no confidence exceeding a two-thirds majority shall immediately remove said Official from office.
· To make all rules and laws which shall be necessary and proper for executing the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Office thereof.
Qualifications for President, Vice President and Congress
While all Citizens are equal under the eyes of the law, it must be acknowledged that not all are equally fit to lead. To qualify as a Candidate for President, Vice President or Congress, the following are required:
- Natural born Citizen of the United States, with both parents being Citizens at time of birth.
- Minimum age of 35 years, with a maximum age of 65 years.
- Having lived at least 30 of the last 35 years in the United States.
- Minimum IQ in the top 5% of the general population as measured by standard IQ tests.
- Be reasonably free of any belief in religion. (I60)
- Being free of conviction of any Federal or State crimes or Treason against this Constitution.
All American Citizens meeting the above qualifications shall register with the Federal Government for possible selection as a member of Congress. Candidates must show evidence of having met the above requirements to a Federal elections committee whose responsibility it is to review said qualifications.
Service in Congress shall be voluntary, but every reasonable effort should be made to encourage said service. Frequently, it is those with no desire to lead who make the best leaders.
Voting System
The Congress shall establish a Federal voting system utilizing the preferred communications medium of the time. Said voting system shall:
- Be fully secure, so as to prevent tampering and unauthorized access.
- Provide voter authentication to prevent theft or alteration of votes.
- Be available for the full 24-hour period of the day of voting.
- Allow a voter to modify their votes during the voting period.
- Allow a voter to verify their votes during and after the voting period.
- Be free of cost to the voter.
- Not require registration of the voter, which shall be automatic upon eligibility to vote.
- Be easy to understand and use for the voter.
- Accurately count votes with an error rate of less than one in one hundred thousand.
A duplicate of this voting system and all voting data shall be made available for testing, verification and analysis by independent parties so requesting.
This voting system shall be utilized for all Federal elections, polls and other matters wherein voter opinion may be counted.
The requirements to be a voter in Federal Elections are:
- To be an American Citizen, have attained the age of 18 years.
- Have an accepted method of authentication to the voting system.
The systems utilized for determining random Congressional Candidates and for determining the Constitutional Committee shall be open and available for verification to interested parties.

Elections
Federal Election rules, regulations and voting mechanisms shall be consistent across States, with all of said determined by the Congress.
All Federal Elections shall be held on the first Tuesday in November, with offices to be taken on the first Monday of February of the following year.
Media coverage shall be required and unbiased and equal for all three candidates for each Congressional seat for at least one month prior to Election.
For Presidential and Vice Presidential Candidates:
- Media coverage shall be required at least biweekly and unbiased and equal for at least the top 50 Presidential and Vice Presidential Candidates from the period one year prior to nine months prior to Election.
- Media coverage shall be required at least biweekly and unbiased and equal for at least the top 20 Presidential and Vice Presidential Candidates from the period nine months to six months prior to Election.
- Media coverage shall be required at least weekly and unbiased and equal for at least the top 10 Presidential and Vice Presidential Candidates from the period six months to one month prior to Election.
- Media coverage shall be required daily and unbiased and equal for at least the top 5 Presidential and Vice Presidential Candidates from the period one month prior to Election. During this final one month period the media shall be forbidden to publish poll numbers on these top 5 Presidential and Vice Presidential Candidates.
The Congress shall determine and dispense a reasonable sum of currency to each Congressional Candidate to be used for their election activities. No more than this sum shall be allowed to be spent on said activities, so that each Candidate will have equal opportunity to gain the votes of the People. Congress may also compensate Candidates who participate but do not win for their time and efforts.
Offices requiring random selection shall be determined on the second Tuesday in November.
Rankings for the Presidential and Vice Presidential Candidates shall be determined by polls, reset monthly, by the Federal Voting System. Specifically, rankings are not to be determined by the amount of campaign financing raised.
Judicial
The justice of Federal law shall be carried out by a Supreme Court consisting of seven members. The term of a Supreme Court Justice shall be seven years, with the senior year member being replaced by appointment of the President each year.
The Supreme Court may establish inferior Courts as necessary to assist in the hearing of Federal cases.
The intent of a law shall be written into the law, and shall have precedence over the exact wording or said law. (I11)
No law shall change in intent or usage over time.
All laws shall be written in clear and plain English that is understandable to the average Citizen, or shall be declared null and void.
All laws which are not consistently applied shall be null and void. (I47)
Citizens cannot be held to laws which cannot be considered intuitive or common knowledge. (I48)
No law shall be passed which is retroactive.
No lawyer except those appointed by the Government shall enter the courtroom. (I46)
All evidence, both legally and illegally obtained, shall be allowed in a court of law and available for both prosecution and defense. Illegally obtained evidence, however, implies a crime and that crime itself must be pursued.
It shall be Treason for any Federal Official, elected or appointed, to lie to or otherwise mislead the People.
It shall be Treason for any person to lie to or otherwise mislead a Federal Official.
It shall be a Federal crime for any Federal appointed Official to perform their duties and responsibilities poorly.
Any and all Federal Elected or Appointed Officials, in addition to other punishments imposed, shall immediately be removed from office upon being found guilty of Treason or other Federal crime.
No more than three quarters of one percent of the People shall be incarcerated at any time, Federal, State and Local combined. Exceeding this limitation shall require immediate freedom of the excess. (I62)
No person shall be tried more than once for the same offense.
No person shall be deprived of life, liberty, or property, without due process of law.
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. (I63)
The Supreme Court shall have jurisdiction over:
- All cases involving violation of Federal Law.
- All cases involving Foreign Nations and ambassadors of Foreign Nations.
- All cases involving Federal Officials acting on behalf of the Federal Government.
- All cases where the monetary value of the dispute is greater than one average year’s wages.
- All cases involving two or more States.
- All cases involving those who are not Citizens of the United States.
- All cases involving the United States and Foreign entities.
- All cases of Constitutional violation where constitutionality of the offense is not an issue.
- All other types of cases the Congress deems appropriate.
All Federal trials shall be by jury, excepting those of Treason, which shall be held before the Constitutional Committee.
No law shall remain valid for more than 30 years. If a law is reasonable and sound, it shall have no problem being voted into law again.
The People shall have the right to a trial within ninety days of being accused of an offense. If no trial should occur in this timeframe, the accused shall be free and innocent. If trial by jury is warranted, then the time limit shall be one hundred twenty days.
The right of the People to be secure in their persons, privacy, location, communications, houses, computers, automobiles, papers, and all other personal possessions, against unreasonable searches, seizures, monitoring, or recording shall not be violated, and no Warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the reasons, the items of interest, and the actions to be allowed.
The Federal Courts, shall offer, to offenders less than twenty five years of age, found guilty of crimes not involving murder or grievous bodily harm, the option of Federal Military service in lieu of time behind bars. (I12)
The Federal Courts, at their discretion, may, when the guilty appears to be a career criminal with no hope of integration as a function member of society, strip the guilty of citizenship and opt for permanent deportation.
The guilty shall have no rights during the time of their crime, nor during their servitude excepting for the right to appeal. (I45)
Bills
A bill shall become law thirty days and one week after the Congress approves of it by a minimum two thirds vote. During the thirty days immediately following the vote, the Constitutional Committee shall review the bill and remove any sections not in compliance with this Constitution. No other modifications are permitted by the Constitutional Committee. During the final week before the bill becomes law, the Congress may vote to reject the final bill as presented by the Constitutional Committee by a vote of simple majority.
Bills of unrelated content shall not be combined together and presented to the Congress for a single vote on the combination thereof. Unrelated laws must pass separately on their own merit. (I13)
Bills may be presented to the Congress for vote only by the members of the Congress, the President, or the Vice President.
Military
Federal Military service shall be voluntary at all times, including during times of war, excepting those cases where service has been chosen over incarceration. The Federal Government has no privilege to force the People into service.
All Federal Military supplies and hardware shall be manufactured in the United States. The Federal Military shall have no dependencies upon Foreign Nations for its functions.
Any and all Federal Military actions, whether lethal or non-lethal, against American Citizens is Treason. All Federal Military personnel shall take an oath not to give or follow orders to take action against American Citizens, and shall reaffirm this oath on a yearly basis.
The Federal Government shall not allow the usage of Foreign Military against American Citizens, which shall also be considered Treason.
The Federal Military shall remain neutral and uninvolved in any and all disputes between the Government and the People.
The Federal Military shall be comprised solely of American Citizens.
(I14)
Budget
The Federal budget for any one year shall be based upon taxes anticipated to be collected that year and a calculation of the currency needed to be added or deleted to maintain a stable currency and economy.
The Congress shall form an Economic Budget Committee of seven members of Congress, whose purpose is to set a Federal budget target amount each year based upon the current and future state of the economy and stability of the currency. This committee shall set only the overall target level of total spending, not what said spending is allocated to.
The Congress shall set a yearly Federal budget based upon the target spending level recommended by the Economic Budget Committee and shall determine the allocations thereof. Spending in excess of the recommended level shall result in compensation cuts to all Federal Elected Officials, and shall be double the percentage of overspending. (I15)
The Congress shall form a Long Term Planning Committee of seven members of Congress, whose purpose is to anticipate and develop plans for future needs and problems. This Committee shall maintain a general plan for five, ten, and twenty years future. This Committee shall present these plans to the Congress for consideration in the budget each year. (I16)
Congress shall make no budget requests which are not of benefit to the nation as a whole. (I17)
No budget allocation or program created by the Congress shall be for longer than 10 years. Every program funded by the Congress shall be given a thorough review for both its value and its efficiency at least once every ten years, or it shall automatically lose its funding.
Currency
The Federal Government shall maintain a fiat currency, and shall be the sole creator and destroyer of said currency. No outside entity, even one acting on behalf of the Federal Government, shall have the privilege to create or destroy currency. The Federal Government shall endeavor to maintain a stable value to this currency.
The Federal Government shall have no debt.
The Federal Government shall maintain accurate accounting and auditing of all its currency, and especially the expenditures of the Federal Military.
The Government shall use standard accounting practices and procedures and maintain a current and accurate balance sheet.

Banks and other Money Handlers
Banks are strictly forbidden to create currency, which is the sole privilege of the Federal Government, and may therefore not lend what they do not have.
Banks may borrow from the Federal Government, under rules established by the Congress, for subsequent lending to business and consumers, excepting for the purposes prohibited by this Constitution.
All banking and investment transactions must be visible and accounted for on standard accounting balance sheets.
Being an attraction for greed and corruption, banks and other large money handlers shall be required frequent audits and intensive accounting.
The charging of interest rates and fees which combine into a lending rate in excess of twenty five percent annual is strictly prohibited.
No bank or other entity shall make loans or collect deposits across State boundaries. (I64)
No debt may be bound to heirs or successors.
A lender has no right or privilege to collect unsecured debt, nor any other losses or costs as a result thereof. A lender may be given the privilege of claiming possession of that which was placed as security against a debt, but nothing more. The lender shall bear all costs related to repossession and shall suffer all losses which may be due to a devaluation of a repossessed security, unless said devaluation was caused intentionally by the borrower. In the event a repossessed security is valued at more than the remaining debt, the lender shall reimburse the difference to the debtor. (I19)
The Federal Government shall be the sole lender and collector of any large pool of debt or currency deemed critical or essential to the stability of the economy or to the Government. The Congress shall determine interest rates, terms and conditions. The Federal Government shall audit and scrutinize this function intensively to ensure there is no fraud or corruption. No part of this function shall at any time be delegated outside the Federal Government. The Federal Government shall be the holder of these contracts, and shall not sell them to outside entities.
The Federal Government shall be the sole lender and collector of all residential and commercial property and construction mortgages, and shall set the terms and qualifications on the contracts pertaining to said.

Taxation
That which is owned outright, free and clear of all debt and lien, shall not be taxed. (I21)
That which may be considered food shall not be taxed. Water also shall not be taxed, but may carry a charge no greater than its actual cost of production and delivery. Food and water are absolute necessities of the People, and the Government shall have no privilege to take advantage of this fact.
Anything imported from Foreign Nations, with the exceptions of food and water, may be taxed at any rate appropriate as determined by Congress.
The sum total of any and all taxes and fees from any source, on any domestically produced consumer item or service, shall not exceed fifty percent of the retail cost of said item or service. The Government shall not have the privilege of selective excess taxation.
No fees or excessive costs shall be laid upon the People’s desires. (I44)
(I22)
Corporations and Business
Corporations are paper entities existing for the purpose of identification and taxation, and shall have no rights or privileges under the law whatsoever. Any actions taken by a corporation are a direct result of instruction of their officers, and said officers shall be held fully and personally responsible.
No corporation, individual, or group acting in concert shall accumulate assets in excess of one percent of the total GDP of the combined States. In such an event, said entity shall be seized by Congress and be divided into a number of smaller independent pieces to be sold. (I49)
Any corporation or corporations acting in concert as a monopoly, large enough to have a significant impact upon the People, shall be broken up into smaller and separate entities, excepting those monopolies which are strictly regulated by Congress. (I50)
No corporation, individual, or group acting in concert shall control any significant portion of the media. (I23)
Business shall provide fair service and product for fair compensation. Excessive profit is theft, and is prohibited. Deceptive practices by Business are also prohibited. (I24)
Congress shall fully regulate all business whose products are considered as necessities to the People. This shall include, at a minimum: food, water, and energy.
Congress may regulate all aspects of the economy, including prices and wages, as necessary for the stability of the economy.
Exposing the People to advertisements in excess of ten percent of media shall be construed as impairment of free will, and shall therefore be prohibited. (I25)
No Citizen shall be bound to a contract which cannot be easily understood by the Citizen. Neither shall any Citizen be bound to any contract whose terms are not fixed for the duration of the contract. (I26)
Congress shall create and regulate standard service contracts, such that it is not required to consult a lawyer for simple everyday life. (I55)
States
The privileges not delegated to the Federal Government by this Constitution, are reserved to the States and the People.
Any and all State laws and privileges shall be subordinate to those of the Federal Government.
States shall have no privilege which shall impair the rights of the People as defined in this Constitution.
Extradition from one State to another shall only be exercised by agreement between the States involved. What is a crime in one State may not be in another, and it is the privilege of each State to decide which offenses shall merit extradition.
The Federal Government shall not promise or withhold funding to States as a means of coercion.
New States may be added to this Union by a vote of two thirds of the Congress, provided the People of the New State also approve by at least a two thirds majority.
States may choose, by a two thirds majority vote of their People, to exit this Union, and shall suffer no retribution from the Federal Government as a result thereof.
States may choose to grant or remove additional privileges to the Congress by a vote of two thirds of their Governors, each State having exactly one vote, so long as said privileges in no way conflict with this Constitution.
States may choose to establish and maintain their own Militias.
Any and all State Militia actions, whether lethal or non-lethal, against American Citizens is Treason. All State Militia personnel shall take an oath not to give or follow orders to take action against American Citizens, and shall reaffirm this oath on a yearly basis.
It is the responsibility of the States and the Constitutional Committee to enforce this Constitution upon the Federal Government and prevent it from usurping powers not contained within. States shall have the privilege of withholding any and all Federal Taxes and Fees they collect, whenever there is belief that the Federal Government has overstepped its privileges, for as long as said matter is unresolved. (I52)
The Federal Government shall recognize a fetus as a person at the generally accepted time recognized by medical professionals when said fetus is capable of living and breathing on its own without medical assistance. The States may choose to recognize the personhood of a fetus at an earlier date. (I54)
Sovereignty
The United States shall be sovereign and independent. The Government shall not make a contract or agreement with Foreign Nations or Entities which is binding. Any and all participation with Foreign Nations or entities shall be purely voluntary, and may be terminated at any time for any reason. The Government shall not enter into agreements which would make it dependent upon a Foreign Nation or Entity.
No Foreign Nation or Entity shall own land or property in the United States. The Government is prohibited from selling or giving away land or property, or using said land or property as security for any debt or other transaction. Leasing of land or property is permitted, but in no case shall the terms of said lease extend beyond ten years.
(I27)
Consolidation of Power
Power shall remain spread across Government entities as defined by this Constitution. No entity may transfer its powers to another. Concentration of power ultimately ends in dictatorship, and shall be prohibited.
National Emergency
The Congress shall, during times of extraordinary circumstance, have the privilege to declare a National Emergency by simple majority vote.
The Congress shall have the privilege to declare the end of a National Emergency by simple majority vote.
A state of National Emergency must be reaffirmed by the Congress for each year it continues.
During the time of National Emergency as declared by the Congress, the following Constitutional rules shall apply:
- The Constitutional Committee shall select a single representative from their members to act as the third party to a National Emergency Tribunal consisting of this representative, the President, and the Vice President.
- The National Emergency Tribunal shall have the privilege to order commands upon business, upon Congress, upon the States, and upon the People, and to pass laws effective for the duration of the National Emergency, with an affirmative vote of two of their three members. Said laws and commands shall be effective immediately.
- The People shall retain all their rights under this Constitution.
- It remains absolutely forbidden to use the Federal Military or the State Militias against the People.
- Federal Elections shall continue as normal, and the People shall be able to vote no-confidence in their leadership as normal.
(I28)
Rights of the People
Knowledge
This Constitution shall be taught in all public schools, during the twelfth year of education. Both this original document and any amendments thereto shall be taught, so that over time it may be known what privileges and rights the originators enjoyed, versus what has been lost or restricted over the years. Knowledge is power, and our children shall be empowered.
Sanctity of Self and Family
No law shall be made to protect a person from themselves. (I29)
That which occurs between consenting adults and causes no harm to others shall not be prohibited. (I30)
The sanctity of the body is an absolute right. No person shall be subject to the introduction of chemicals or devices into their body, and none of their rights and privileges will require such. (I31)
The sanctity of free will of the mind and the right to privacy therein is an absolute right. No person shall be subject to the alteration of their will, nor the reading of their thoughts, and none of their rights and privileges shall require such. (I32)
The sanctity of the family shall be preserved. Government shall place no restrictions or requirements upon the structure of, function of, or the raising of children within, a family. (I33)
The Government shall have no privilege to segregate or desegregate the People, or to enforce quotas upon them based on race, religion, income, sex, or any other factor. (I34)
The Government shall have no privilege to know or track the location of the People, or their property which can be moved. (I35)
The People reserve the right to their properties, and no properties shall be seized for use other than by the Federal Government, and not without just compensation. (I36)
The right to privacy of a Citizen is inherent in all transactions and activities. (I37)
Firearms
It is the absolute right, and in fact the duty, of every American Citizen to overthrow their Government when it has proven itself corrupt and non-representative of the People it is supposed to serve. Therefore, it is the absolute right of the People to possess any and all arms, offensive and defensive, lethal and non-lethal, that the Federal, State or Local Governments might use against them. Said possession shall be without restriction, without registration, without taxation, without fees, without any hindrance whatsoever, for any citizen not having been declared mentally incapacitated and not having been convicted of a violent crime.
The People shall retain the right to posses all conventional hand-carried weapons, excepting projectile weapons with explosive charges, regardless of whether the Government chooses to utilize them or not.
The People shall have the unhindered right to carry all arms, open or concealed, fully loaded and ready to use, in all public places except inside Federal, State and Local Government buildings.
The People shall have the unhindered right to transport all arms upon all modes of ground or water-based transportation.
The People shall have no right to own chemical, biological or nuclear weapons, military aircraft, military helicopters or other significant military hardware as is used solely by the military and poses no threat to be used against them.
The People shall have the absolute right to use deadly force while protecting life and property.
(I38)
Religion
The People shall be free to practice their religion, but only so long as it advocates peace and goodwill and does not condone violence or retribution. (I42)
The preaching of hate and violence shall not be tolerated and shall be strictly prohibited.
All elected and appointed Federal Officials must be reasonably free of religion or be removed from office.
All Religious groups shall be forbidden from any and all participation in Government or elections. (I43)
Science and logic shall prevail in the public school systems. No religion shall be practiced or tolerated therein, excepting courses in comparison of various religions around the world.
Congress may regulate religion and religious groups as they see fit and appropriate.
Communications of the People
Congress shall maintain cheap and easy access for the People to the generally recognized mass communications medium of the time. Said medium shall be without censure excepting those communications which involve acts which are illegal and have been authorized by warrant.
Congress may pass laws requiring classification of content to provide the People with the ability to filter out that which they find offensive. Owners and suppliers of said communications medium cannot be held responsible for the content of their services. Responsibility thereof is the sole liability of the poster of said content. Cheap, easy, instant, uncensored communications and exchange of information between the People is an absolute right that shall not be infringed.
(I39)
Additional Rights
The People shall have the right to Free Speech. (I40)
The Media shall be free to print what it wishes, excepting the requirements placed upon it for the election of Federal Officials.
The Media shall have the right to hold their sources secret.
The People shall have the right to assemble peaceably, and to petition the Government to hear and address their problems and complaints.
The People reserve all rights not given herein to the Government as privileges, and reserve the right to revoke privileges given the Government as necessary.
Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction. (I59)
The People reserve their rights to all man-made and natural medicinal remedies. Medical treatment of the People is a necessity and shall not be restricted or denied. (I41)
The People shall have the right to a vote of no-confidence against their Federal Elected Officials during each Federal Election. Federal Officials receiving a vote of no-confidence in excess of sixty percent shall be immediately removed from office. (I51)
Any and all Government surveillance of the People, performed without warrant, shall be deemed a violation of the right to privacy of the People. (I53)
Non-Citizens
The rights of the People declared in this Constitution are reserved to American Citizens and to those Non-Citizens having legal entry status.
Non-Citizens in the United States illegally shall have no rights or privileges of Citizens. But whenever caught, shall, as a matter of courtesy and expediency, be provided a speedy trial and access to Government lawyers in their defense. Unless serious offense has been committed, immediate deportation shall be required.
Proof of Citizenship or legal entry status shall be required for all Government benefits, rights, and privileges.
Proof of Citizenship or legal entry status shall be required for all contractual transactions.
Constitution Amendments and Modifications
Amendments and Modifications to this Constitution shall only be made by affirmative vote of three quarters of the Congress, and of three quarters of the States, and of three quarters of the People, all of which must occur within a four calendar year period.
Intentions
(I1) Someone needs to make sure that this contract with the People, the Constitution, is followed and enforced. This is the purpose of the Constitutional Committee. Experience has shown that without enforcement, laws will be ignored. Being that this committee is the highest authority in the country, they are also given the task of making sure that military conflict cannot be used for profit. While it is desirable to have a strong military, usage of said must be done with great discretion. There is no intention here to limit military spending or profits during times of peace. Only when the military is used in conflict shall there be no profit.
(I2) People generally prefer to rally behind a single leader rather than a committee. The intent here is to give the People the leader they desire, while strictly limiting the powers. The President has sufficient power to have influence, but the Congress and the Constitutional Committee provide balance and the final authority.
(I3) There is no reason the Vice President cannot have a significantly important position, and so is given one. This also helps remove some of the excessive powers of the Presidency.
(I4) Limit lobbying by limiting the number of Congress members they have access to. They should not have any more access than a Citizen.
(I5) The Congress exists to serve the needs of the People. The Vice President is the proper contact for Foreign Nations and entities.
(I6) Our children are our future, and we are obligated to leave them more than just a worthless toxic garbage dump. Let's not use up all the energy and make our children read in the dark. Let's not use up all the natural resources and deprive our children of a decent life. Let's not turn the country into a toxic waste dump and torture our children with health problems and abnormalities. Let's keep this place nice, for them, so they can enjoy it too.
(I7) The days of the People competing for jobs are over. Jobs will now compete for People. This will cause some difficulties with the economy, and Congress therefore has the privilege of regulating prices, wages, and whatever else they need to keep the economy stable and functioning.
(I8) An economy based on greed is dangerous. Capitalism is a powerful motivating tool, but those who play with fire inevitably get burned. Whatever economic model the United States should choose in the future, it should be one that rewards hard work and punishes laziness. There is nothing more irritating than busting your butt while the guy next to you does nothing, all the while knowing that you are both paid the same.
(I9) Go ahead. Give it a great big bear hug. Complexities stress People, and stressed People are not happy People, and that is contrary to the directive of this Government. Life is hardly possible in these times without an assistant, so: Keep It Simple, Stupid.
(I10) Paper ballots are already archaic and only marginally verifiable. Electronic voting machines are completely unverifiable and an absolute insanity. With current technology, a secure connection over the internet using social security number and a password for authentication to cast votes on a web page is sufficient to vastly surpass any other voting system in regards to accuracy, verifiability and voter access. One day it may be possible to simply think of what you want to vote for and have said vote registered and counted. Because of this, the method and medium are intentionally not specified. The intent is authentication, accuracy, verification and access.
(I11) No more word games with lawyers or technical loopholes. None of us are perfect, and cannot be expected to be. The original intent of a law, at the time it was written, is what shall be enforced.
(I12) Sometimes young People just need a little bit of guidance and discipline. Military service is far preferable to incarceration. The offender learns skills and has a chance to become useful to society.
(I13) No more sneaking bills which wouldn’t pass on their own into a package of bills that is desirable resulting in a big pile of --- that passes as law only marginally. Large packages of bills are unintelligible, and must be broken into smaller pieces to be clearly understood and voted upon.
(I14) Beyond the fact that the Federal Government has absolutely no right to force a Citizen to go get themselves killed... a strictly voluntary military has the desirable effect of removing warmongers from the gene pool. Violence is a trait that should have no future in human evolution. Charles Darwin would be proud. The Federal Military exists solely for the protection of the People, and may not, under any circumstances, be used against the People.
(I15) There is a penalty for spending over budget and not hitting the target to keep the economy and the currency stable. Overspend by 1%, and you get a pay cut of 2%. The budget target is set by a small committee of Congressional members whose purpose is to work with various experts to determine a proper overall level of spending. This is handled separately from actual allocation, because it allows much greater objectivity.
(I16) It is not acceptable to pass problems along to the next generation to handle. Anticipate them and begin handling them now. The entire country is dependent upon the leadership and direction of the Government. But what good is a Government if it plans no further out than today? It is insane to govern without both short and long term planning.
(I17) No more pork or earmarks for budget items that should be State or local projects. The Federal budget is for Federal spending which benefits the nation as a whole, not individual members of Congress.
(I18) No more debt-based monetary systems. These were invented by bankers as a means to make themselves rich. A currency maintained by the Federal Government, not based on debt, is perfectly adequate, although non-profit. Currency is destroyed as it is collected in taxes and fees by the Federal Government. Currency is created as the Federal Government spends. Various other mechanisms also exist to add or remove currency to/from the economy, and the system works well when the Federal Government maintains a balance of spending relative to taxes.
(I19) The lender shall be the expert in lending, and onus is upon the lender to assure themselves that a loan will be repaid before they make it.
(I20) History has proven to us as fact that Bankers are indeed far more dangerous and destructive than Armies. Allowing Bankers access to a large pool of money such as mortgages is akin to throwing a pack of wolves into a henhouse. The Federal Government shall set the terms, provide the loan, and manage the collection of payments as well. You borrow from the Federal Government, and make your payments directly back to the Federal Government. The property market is too large to trust to a greed-driven capitalistic system. It shall therefore be handled by the Federal Government, who has no interest in it. In the future, it may be that housing is not a significant debt, and that everyone borrows to buy themselves a spacecraft. Who knows? The intent is to keep the large pools of debt away from the bankers, who have proven themselves countless times to be nothing but leaches upon society and a bane to humankind.
(I21) If you've fully paid for your home the Government cannot tax you on it. Same with your car. Personal property taxes are forbidden on property that has no debt on it and is not being used as security against debt. In other words, if you've paid for your car then it is tax free, unless you decide to use it as collateral for a debt, in which case it is taxable once again.
(I22) Food and water will not be taxed, as they are absolute necessities to the People. The Government shall also not be allowed to take advantage of other necessities or desirable consumer items. Example: alcohol and tobacco, both of which suffer taxes far in excess of their actual value. And of course, one must prevent the Government from taxing firearms into oblivion as well.
(I23) The media is far too powerful for any one entity to be allowed to control any significant amount of it. Media must always be broken in small pieces to afford the People a variety of opinion. Significant currently would mean three newspapers, or two television stations, or one major news website. Think small.
(I24) Rip-offs, substandard services, surprise fees, poor construction, cheap junk, deceptive packaging, bait-and-switch, adding water to increase weight, and the myriad other ways in which business continually attempts to screw the People are now officially prohibited. There are so many consumer items and services available, that it is impossible for the consumer to be educated on them all. Onus is now placed on business to provide fair value.
(I25) Yes, it is mind control. Basic intent is strict limitation of exposure. For example, no more than 10% of a web page may be used for advertisements, or 6 minutes per hour of television. Business has no right or privilege to mess with our minds or free will.
(I26) If it's not readable and understandable, then it is useless and void as a contract. Also prohibited are contracts and license agreements which tend to change arbitrarily, such as the EULA's for various websites.
(I27) We are, and will remain, independent. Period. This land, and everything upon it is ours, and no one has authority to sell it or give it away, and most especially not to any Foreign Nation or Entity.
(I28) Sometimes it is necessary to just take charge and act quickly. An example might be the eruption of the Yellowstone caldera. But also of concern is that all this power is not given to just one man. Therefore, a tribunal is created for at least a small amount of balance and a sanity check to the actions taken under the National Emergency. Three People can still act quickly enough, but with the advantage that actions and responses get a little thought. Elections and replacement of Officials are still held as normal, on purpose, because if there is a National Emergency everyone will be paying attention, and there is only disadvantage and room for abuse of power having the same Tribunal members for an extended period of time.
(I29) If an action may cause harm only to the person performing the action, the Government has no privilege to make laws against it. Government's purpose is to protect People from others, not themselves. For example, a law requiring a bicycle rider to wear a helmet is absurd.
(I30) Again, if it harms no one but those involved, the Government has to privilege to make it illegal. For example, oral sex, prostitution, sky-diving, bungee jumping, etc. There is no evidence that any of this is harmful or even non-normal. And again, the Government has no privilege to tell the People how to live, only to protect them from nonconsensual harm.
(I31) The body of a person belongs solely to that person, and no one has any right or privilege to makes requirements upon it. Example: requiring vaccinations to be allowed access to public schools is illegal. No one can be forced into violating their body. Neither can they be denied rights or privileges because they have chosen to decline a violation. Exceptions can be made under extraordinary emergencies, such as the temporary sedation of a violent patient in a hospital who poses a significant threat to others.
(I32) Mind or mood alteration or control of the People in any form is absolutely prohibited. The thoughts of a person are an absolute privacy. In short, the mind and body of a person are strictly off limits.
(I33) Stay out of my life. Monogamy, Polygamy, Communal, Same Sex, Patriarch, Matriarch and various other family structures are all valid and normal. Government has no privilege to regulate or dictate what a family should be. Further, Government has no privilege to regulate or dictate or put requirements upon how a family raises its children. The one exception being serious or grievous harm to a child, but this must be shown to be far outside the norm for society.
(I34) The People reserve the right to live, work and go to school wherever they want. All People are to be treated equally, with none receiving special privilege over others.
(I35) No GPS devices required in your car or on your person. The Government cannot track your location without a warrant. Your location is a personal possession too.
(I36) No, you can’t take a person’s home to build a mall by declaring it public use. Property can only be taken when the Federal Government will be the owner and operator.
(I37) My trash can is not public, even after the trash hits the landfill. My spending habits and web surfing are not public. Nothing I do is public, unless I grant permission for it to be public, or it is already public in nature. Using a web service to send a message to a friend would be considered private, while posting a message on a public blog would be considered public.
(I38) The basic intentions are: that the People be equally as armed as the Government should the Government turn against them; that the People have the right to protect themselves, and can only do so if they can carry their weapons with them at the ready; and that since it is forbidden to use the Military against the People, the People have no need for RPGS, mortars, bazookas or other hardware specific to warfare, unless of course, the Government decides that it might use said against them.
(I39) What we currently know as "the Internet" has been the biggest contribution to the freedoms of the People in history. Instant communications, freedom of speech, massive information exchanges, with anyone and everyone around the world, unregulated, untaxed, unhindered, all at a cost that is almost if not in most cases free… this is of unimaginable value to the People and must therefore be treated as a right of the People. Also of concern is the fact that the mainstream media cannot be trusted to report the truth, or will even report at all, on events which may be of concern to the People. The ability of the People to post their own views and report on events that are of interest to them shall also be maintained.
(I40) In times and places as appropriate. You have a right to voice your opinion, but not the right to be looney about it. Screaming obscenities at a Kindergarten class is not a Free Speech right. Screaming obscenities at a Politician, however, is.
(I41) Requiring prescriptions for medication is a scam. Infinitely far more harm has been done by allowing the utilization of antibiotics in animal feed. The People reserve the right to treat themselves for their ailments.
(I42) Being that throughout history, religion has proven itself to be the cause or justification for a myriad of unimaginable offenses to humanity, it is hereby declared to be a most heinous disease. Further, religious leaders are even more dangerous than Bankers, because while a Banker will charge you to live, a Preacher will not only charge you, but tell you how to live as well.
(I43) Religion has been scientifically proven to relieve the believer of self responsibility and impair logical function.
(I44) Charging an arm or a leg for a liquor license, or putting only a few up for auction thereby making them excessively expensive when a restaurant license costs almost nothing, is forbidden. In other words, making money off things that People enjoy is forbidden. Taxes, fees, and other costs should be kept level and even across the entire field.
(I45) A thief cannot sue a store owner when the thief falls through the roof and hurts himself. While committing a crime, the criminal has no rights. Those who are incarcerated have no rights either. Prison is not supposed to be pleasant. All rights return upon release.
(I46) Everyone gets the same lawyers. The government will provide prosecution and defense lawyers to help uncover and present arguments on both sides of the case.
(I47) The Government cannot selectively apply, or not apply, a relevant law to one man and not to another. There shall be equal and consistent application of a law, or it is void.
(I48) The propensity of a Government to create laws is well known, and it is absurd to the extent that no one on the planet can possibly know them all. Citizens can only be held responsible to a number of laws which they can be reasonably expected to remember or deduce intuitively. There is, however, expectation that plumbers should know plumbing laws, and electricians should know electrical wiring standards, etc. Meaning, that it is reasonable to expect a Citizen to know the laws relevant to their field of work.
(I49) Businesses must not become “too big to fail”. Once a business reaches this size, it is a hazard to the economy and the People.
(I50) Strictly regulated meaning prices, wages, fees, etc are all regulated.
(I51) People can vote confidence/no-confidence for their Congressional Representative, the President and the Vice President. Yes, the intention is that if People get peeved with their leaders, said leaders can be removed.
(52) Nothing gets a point across like withholding money. States may put pressure on the Federal Government by withholding taxes and fees collected when they believe the Federal Government is overstepping its privileges under the Constitution. In theory, the Constitutional Committee should have prevented the complaint in the first place. But just in case they didn’t, States are given the privilege to complain a little louder and force a review. Although the Federal Government has the privilege to simply print more money whenever it needs to, this still gums up the works a bit.
(I53) Video surveillance by the Government is forbidden. That means speed cameras too. Surveillance in general is a violation of privacy, because there is no probable cause of any crime being committed, and hence the People are assumed guilty, which is forbidden. Private Citizens and businesses may monitor their own private property.
(I54) This time is currently 7-8 months. And, of course, excepting the case of murder of the mother, wherein the fetus shall count as a person regardless.
(I55) Needing a lawyer to interpret and review a service contract with the phone company just to get a mobile phone is absurd. Ditto for EULA’s. Ditto for buying a house or a car. Even getting a tune-up on your car currently requires signature on a multiple sheets of fine print contract. This is all absolutely insane. Congress shall establish standard service parameters so that everyone understands the rules and no one needs a contract. Have you seen the paperwork for auto insurance lately? Health insurance contracts are the size of novels.
(I56) The Vice President is a fully independent office from that of President, and the Vice President is not subordinate to the President. In other words, the President could order the Vice President to command the troops to do something, to which the Vice President can tell the President: “bugger off”.
(I57) Not to establish standard practices and procedures for Doctors, but to remove bad Doctors from practice. Doctors and Patients should be free to determine their best possible course of treatment. Malpractice needs to be throttled, as it can drive good services, such as childbirth, out of existence.
(I58) Because no one gets a free ride. There is always something to do, and if you don’t pull your weight, you don’t get squat. Welfare must be eliminated. The Workfare Program can provide transportation, jobs, childcare, and everything else it may need as well. Taxpayers will not give away their hard earned money.
(I59) Kept exactly as worded from the original US Constitution. This is very clear. NO involuntary servitude WHATSOEVER. This means no conscription, no mandatory community service, no mandatory or forced anything. Period.
(I60) Going to church every week is disqualification. Going once a month, flip a coin. Belief in creationism, or any other denial of evolution, is disqualification. Logic must prevail over faith.
(I61) The intent is to keep the Federal Government at a higher level, and not to allow them to do things like tax your television.
(I62) If there are too many people in jail, then there is something wrong with the laws, society, or the government, not the people. Find and fix the real problem that is causing such high incarceration levels.
(I63) Hard labor is not cruel or unusual.
(I64) Banks should be kept relatively small and their business kept within a single state.
